TERMS OF USE / PRIVACY POLICY

SPIRAL/Wacoal Art Center manages this site. When making use of this site, please be aware of the terms set forth below. The company may change the terms of use for the site at any time. At such time as any changes are made, we will post a revised version of this document, and it is your responsibility to familiarize yourself with any changes or additions that have been made. In respect of matters pertaining to copyright, limitation of liability, we are obliged to make the relevant terms public and display them in such a manner that anyone can easily find out what they are. For that reason the terms are displayed below. Please read them.

1.Rights holder of data

Irrespective of ownership, the company owns all rights, and the power to exercise such rights, pertaining to the text, binary and images and all data ("data") in this site including, but not limited to, text, photographs, music, programs, and trademarks, logos such as copyright, secondary copyright, trademark rights, design rights, patent rights and proprietorship.

2.Restrictions on the use of data

There are restrictions governing the use of data based upon arrange of intellectual property laws including, but not restricted to, copyright law, trademark law, patent law, design law, unfair competition prevention law, and so forth.

In the event that you download data from the site, the company grants you permission to non-exclusive use of the data, but no rights of any kind are conferred upon you, and you are only allowed such use of the data as falls within the parameters of the "terms of use."

In the event that you have downloaded data from the site, with the exception of personal, non-commercial use, under no circumstances can you make use of data of the company without prior permission from the company. Using the data for personal use is defined as non-commercial individual use with one-time reproduction of the data on a single computer per individual.

It is forbidden to broadcast, to publicly transmit (or make into transmissible format), to exhibit or display, to show in cinematic form, to circulate, or lend out the data without prior permission from the company.

Installing the data as if it were your own data, installing the data on more than one computer, quoting the data, modifying the data, editing the data, as well as reverse-assembly, reverse-compiling or reverse engineering of the data is not permitted without the prior permission of the company.

3.Contributions and Suggestions

With the exception of comments and opinions regarding this homepage, the company does not accept any ideas for its new products, product or service names, or production methodologies from third parties. This is in order to avoid the eventuality of any such third-party mistakenly claiming that original ideas of Wacoal Art Center. originated from the said third-party, and not from the company. Irrespective of ownership, the company owns all rights, as well as the power to exercise such rights, pertaining to the text, binary and images and all data ("data") in this site including, but not limited to, text, photographs, music, programs, and trademarks, logos such as copyright, secondary copyright, trademark rights, design rights, patent rights and proprietorship.

4.Modification

Under no circumstances does the company permit any form of modification (defined as the changing and/or deletion of the data in whole or part) as this is an infringement of Clause 20 of the copyright law, the right to preserve consistency.

5.Dissolving the agreement

If, based on appropriate cause, the company decides that you have contravened any of the regulations of the terms of use, the company has the right to dissolve the agreement that exists between us with regard to permission for the use of the data. At such a time as the agreement is dissolved, your use of the data will immediately be nullified, and you must erase all the data and any copies thereof taken from this site.

6.Protected Regions

The copyright and/or secondary copyright for the data is protected not only under the copyright law, and related laws, of Japan (the country from which the data is being transmitted), the Berne Treaty, copyright conventions with numerous other countries, and other international agreements, but also the copyright laws and related laws of the country where the data is received, and the country where the data is used. In the case of use between multiple countries including Japan, as well as use in countries excluding Japan, should the data be used in a manner which contravenes these terms of use, or should the data be used in an improper manner which contravenes the above listed laws and international conventions and agreements, such use will constitute an unlawful act.

7.Effectiveness of agreement

In the event that a portion of the terms of agreement becomes invalid, or impossible to implement due to some cause, the remainder of the terms shall continue to remain in effect.

8.Applicable law and jurisdiction

Japanese national law shall be the applicable law in respect of the mutual agreement with regard to terms of use, and with regard to all matters pertaining to the site. The sole controlling jurisdiction as regards the mutual agreement with regard to use, as well as disputes that arise in connection with this website or any litigation, will be the Osaka District Court in Japan.

9.Disclaimers and limitation of liability

The company offers the data to be used on an "AS IS" basis. No representations or any kind of warranty are made, whether express or implied, with regard to content, satisfactory quality, or fitness for a particular purpose. The company is in no way liable for damage resulting from viruses that occur in the data, or if there is any defect within the data. Moreover, the company is in no way liable for damage arising from function interruption, difficulties in transmission or reception, errors, or any other eventuality having its origin in use of the data, irrespective of the cause. The company does not accept complaints with regard to such matters. Moreover, it is you who must bear all necessary expenses for eliminating viruses, correcting defects, or the repair/restoration of damage and/or poor performance.

個人情報保護方針全文

個人情報を取り扱う部門ごとに情報管理者を設置するとともに従業者の役割と責任を明確にし、個人情報の適切な利用と保護に努めます。
お客様に個人情報の提供をお願いする場合には、その利用目的、対応窓口などをお知らせし、目的の範囲内で個人情報を適切に取得し利用します。
個人情報は、法令の定める場合など正当な理由のあるときを除き、ご本人の許可なく、その情報を第三者へ開示・提供することはありません。
個人情報を業務委託先に預託する場合は、当社と同等の情報保護を行うことを契約により義務付けたうえで管理監督を行い、流出などを防止します。
個人情報を正確かつ最新の状態に保つよう努めるとともに、流出、改ざん、漏えいなどを防止するため、合理的な安全対策を講じます。
お客様が当社に提供された個人情報の開示、訂正、利用停止などを希望された場合は、ご本人を確認したうえで合理的な範囲で対応します。
個人情報の取扱いに関するお客様からの苦情を受けた場合、適切かつ迅速な対応に努めます。
個人情報に関係する日本の法令、当社の加盟する事業者団体のガイドラインを遵守するとともに、個人情報の取扱いについても継続的に見直し、その改善に努めます。

「個人情報の保護に関する法律」に基づく公表等の事項に関するご案内個人情報の保護に関する法律（以下、「法」といいます）は、所定の事項を公表、または本人が（容易に）知り得る状態に置くべきものと定めております。これらの事項に関して、その公表等のため以下に掲載いたしますので、ご覧くださいますようお願い申しあげます。

1. 当社が取り扱う個人情報の利用目的（法第18条1項関係）

スパイラルの施設および当社が運営する店舗におけるサービス開発、向上改善、催事の企画、マーケティングのためのアンケート等に関する調査依頼のために利用いたします。
スパイラルが提案する催事、商品及びサービスに関するお知らせ、販売促進活動等、アフターサービスのために利用します。
商品、景品の発送等をするために利用します。なお、ご本人から直接書面、WEB申し込み画面に記載された個人情報を取得する場合は、その都度利用目的を明示いたします。（法第18条2項関係）その場合、個別の利用目的の内容が以上の記載に優先いたします。

開示等の求めは、上記宛に所定の書面に必要書類を添付のうえ、郵送によりお送りください。直接、ご来社によるお申し出、電話、ファクシミリ、電子メールによるお申し出の受付窓口は、開設いたしておりません。その旨ご了承くださいますようお願い申しあげます。なお、当社は開示等の受付窓口を親会社の株式会社ワコールに委託しております。
1. 開示等の求めに際して提出すべき書面等
  開示等の求めに関する当社所定の書式は、「開示」「訂正等」「利用停止等」の種類を明確にして、下記まで電話または郵便でご請求ください。当社より所定書式と記入説明書を郵送いたします。なお、ご本人確認のための書類が必要になりますが、詳しくは記入説明書をご覧ください。

2. 代理人による開示等の求め
  前項の書類に加えて、代理人確認の書類が必要になります。開示等の求めに関する当社所定の書式をお申し込みの際に、代理人による開示等の求めである旨をお伝えください。詳細を記したご説明資料を当社所定の書式に同封いたします。
3. 開示等の求めの手数料および徴収方法
  1回の申請ごとに、800円（手数料および書留郵便料金 800円分）の郵便切手を申請書類にご同封ください。手数料が不足していた場合は、その旨をご連絡いたしますが、所定の期間内に不足分のお支払いがない場合は、開示等の求めがなかったものとして対応いたします。
4. 開示等の求めに対する回答方法
  開示等に関する当社所定の書面に記載された申請者住所宛に書面により回答をいたします。
5. 開示等の求めに関して取得した個人情報の利用目的等
  開示等の求めに関して取得した個人情報は、開示等の求めに必要な範囲内で取り扱うものといたします。
  なお、上記の開示等の手続きとは別に、連絡先変更等の訂正、利用停止、問い合わせ等に関しては、当社がご本人に通知した説明書等の書面、ご利用約款、WEB申し込み画面等に記載された手続きによる対応を用意いたしております。

3. 「苦情」の受付窓口に関する事項（法第24条1項4号、施行令第5条、法第31条関係）

4. 備考
当社が、ご本人への通知、ご利用約款等のご承認の方法により、別途、利用目的等を個別に示させていただいた場合等には、その個別の利用目的等の内容が、以上の記載に優先いたします。ご了承くださいますようお願い申しあげます。

ウェブサイトの閲覧状況等のログ情報

（3）スパイラルは、法令の定めによる場合を除き、同意なしに第三者に個人情報を提供することはありません。スパイラルは、どのドメインからいつ頃スパイラルのウェブサイトにアクセスがあったかを示すログ情報を得ることがありますが、この情報は全体の傾向を知り統計を取って分析するためのものです。分析後は廃棄します。
スパイラルは、そのウェブサイトで「クッキー（cookie）」と呼ばれる技術を使用していることがあります。クッキーは、ウェブサイトから選択した情報の一部がコンピュータに送信され、ハードディスク上に保存される技術です。スパイラルのウェブサイトに再度アクセスした場合、保存されているクッキーの情報がスパイラルのウェブサイトに送信されます。これは再度スパイラルのウェブサイトを訪れたときに、より便利に利用していただくためのものです。インターネット利用者はクッキーが送られてきたときに通知するよう設定し、クッキーを受取るかどうか選択することができます。
